“Official Rules” for MINISO USA

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

 

  1. Eligibility: Sweepstakes (the “Sweepstakes”) is open only to individuals who are resident of California, Virginia, State of Washington and Texas and who are 21 years old of age or older on the time of entry (each a “You” “Participant”). The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
  2. Sponsorship: The Sweepstakes is sponsored by MINISO(HENGQIN) Co., Ltd., located at FLAT/RM 1402, NO. 109 BULDING, RONGZHU STREET, HENGQIN NEW DISTRICT, ZHUHAI, GUANGDONG (“Sponsor”). Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals, are not eligible to participate. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.

 

  1. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.

 

  1. Entry Window: Entries will be accepted starting on or about April 1st, 2023 PST, and ending April 17th, 2023 PST.

 

  1. Method of Entry: The entry must fulfill all sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may enter only once and you must fill in the information requested. You may not enter more than one time by using multiple phone numbers, email addresses, identities or devices in an attempt to circumvent the rules. Submissions are limited to the State of Washington, California, Virginia and Texas. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor. The Sponsor is not responsible for entries made but not received and/or accepted, and that such entries are void, for example, lost entries, late entries, incomplete, damages or otherwise impossible to process entries, technical failures in the entry process, fraudulent interference with the entry process.

 

There are two ways to enter the Sweepstakes during the entry period:

  1. Receive Entry Voucher When You Complete This Actions:

Purchase your favorite blindbox from Miniso, then you will receive the entry voucher from Miniso’s staff at the time of checkout from April 1st, 2023 to April 17th, 2023. The Sweepstakes must be entered by submitting an entry using the link:            https://us-miniso.good-idea.tech/h5/#/?c=us                                   .  There is a limit of one voucher entry per purchase/transaction. If by reason of any problem, whether mechanical, technical, due to human error or omission, or other means the order cannot be completed, no Entry will be recorded. Please refer to the instructions in Rule 5.B. below on how to enter without making a purchase. Method A voucher entries must be received by the Sponsor by April 17th 2023 11:59PM PST in order to be valid.

  1. Receive Entry Voucher Without Making a Purchase (AMOE):

            To receive one entry voucher without making a purchase, click on this link (https://us-miniso.good-idea.tech/downExcel/index.html) and you will then be directed to an AMOE form that you must complete by providing your first and last name, address, and email address, confirming your email, phone number and date of birth and checking the box to confirm that you have read and agree to the Official Rules and that you are eligible to enter the Sweepstakes. You may participate the Sweepstakes by printing the filled AMOE form and mailing a legibly handwritten, self-addressed, stamped envelope with sufficient postage to 1050 Lakes Drive, Ste 260, West Covina, CA 91790.  DO NOT SEND ANY WINNING GAME STAMPS, COMMENTS OR QUESTIONS TO THIS ADDRESS. All Method B AMOE forms must be received by Sponsor by April 17th 202311:59PM PST in order to be valid. Miniso will mail back the voucher using the self-addressed stamped envelope provided by you. You shall promptly entry the voucher via scanning the QR code by May 1st 2023 11:50 PM PST in order to be valid.  

 

  1. Prizes: Winners will receive Diamond Giftbox with approximate retail price of $4,000 (USD) OR a Crystal Giftbox with approximate retail price of $129 (USD). Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Sponsor to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

  2. Odds:     The odds of winning depend on the number of eligible entries received. Limit one Prize per selected Participant.

 

  1. Winner selection and notification: Winner will be immediately revealed at the time of scanning the voucher’s QR code. The vouchers are packed in a randon drawing under the supervision of the Sponsor. Winners will be contacted via the email to the email address they entered the Sweepstakes with within fifteen (15) days after the entry window is closed. Sponsor shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. Sponsor shall have no liability for a winner's failure to receive notices due to any technical errors. The winner must respond within five (5) business days of receipt of notice and provide Sponsor with all requested information, which may include, without limitation: Participant’s first and last name, address and phone number. Prize claim documents (“Prize Claim Documents”) will then be sent to the potential winner via mail after the potential winner’s response. The Prize Claim Documents for the potential winner will also include an Affidavit of Eligibility, release of liability, prize acceptance, publicity release(where permitted by law), a W9 form (for 1099 filing), and any other documentations reasonably requested by Sponsor, all of which the potential winner must complete and return within ten (10) days of the date the Prize Claim Documents are sent to the potential winner. Prize Claim Documents that are completed and duly submitted to Sponsor within the required period will be verified within approximately eight (8) weeks after the Prize Claim Documents are received or as soon thereafter as reasonably practical, and once verified, the winner will receive the Prize in approximately eight (8) weeks following verification. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited.

 

The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

 

  1. Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules.

 

Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

All details and other restrictions of prize not set forth in these Official Rules will be determined by Sponsor in its sole discretion. If Sponsor so elects, a potential prize winner may be required to submit to, and cooperate in, a confidential background check to confirm eligibility and security requirements set by the Sponsor to help ensure that the use of any such person in advertising or publicity for the Sweepstakes will not bring Sponsor into public disrepute, contempt, scandal, or ridicule or reflect unfavorably on the Sweepstakes or the Sponsor as determined by Sponsor in its sole discretion.

Any difference between the approximate retail value and the actual value will not be awarded and any difference will not be refunded. There is no substitution or cash equivalent for any prize, except that Sponsor in its sole discretion can substitute a prize for a prize of equal or greater value for any reason, including if a prize is not available. All income and gift taxes (including, without limitation, federal, state and/or local income and gift taxes) on or connected with any prize (and the transfer thereof), and the reporting consequences thereof, are solely the responsibility of the winner. If required by law, Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any taxes due. Expenses not stated for any prize are the sole responsibility of the applicable winner.

By entering the Sweepstakes, you agree to receive email newsletters periodically from Sponsor. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.

  1. Limitation of Liability: By entering, you assume all risk of loss, damage, destruction, delay and misdirection of Prize Claim Documents and are advised to obtain insurance where appropriate. Sponsor and each of their parent companies, subsidiaries, affiliates, franchisees, local advertising cooperatives and Miniso website developers, digital/advertising/promotion agencies, and all of their respective shareholders, officers, directors, agents, representatives and employees (individually and collectively “Sweepstakes Entities”) are not responsible for:

(a) incomplete, misdirected, late, lost, garbled, unintelligible, damaged, stolen, non-delivered or postage-due submissions of Prize Claim Documents or other Sweepstakes-related materials whether caused by Participants, wireless carriers, Internet Service Providers (“ISP”) or unauthorized human intervention;

(b) any damage to a Participant’s or other person’s computer system or Digital Device which is caused or occasioned by accessing the Miniso website, participating in the Sweepstakes or claiming an Sweepstakes prize;

(c) technical difficulties or failures of any kind including, but not limited to, lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet, Digital Device or wireless carriers, websites or other connection, availability or accessibility problems arising in connection with or over the course of the Sweepstakes;

(d) miscommunications, failed, jumbled, scrambled, delayed, dropped, interrupted, lost, non-delivered or misdirected computer, telephone, Digital Device, email, mobile or cable transmissions or hardware, software, program or programming malfunctions, failures or difficulties of any kind including, but not limited to: malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computers, equipment, programming errors, cable, satellite, cellular tower or ISP or wireless carriers;

(e) any technical malfunctions, failures or difficulties, printing errors, clerical, typographical or other errors in any Sweepstakes advertisement or other materials or any Prize Claim Documents;

(f) any errors or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, digital, mobile or technical in nature, or unauthorized human intervention;

(g) any incorrect or inaccurate information, whether caused by the Miniso website or tampering, hacking, or by any equipment or programming associated with, or utilized in the Sweepstakes, including, without limitation, Entries that are submitted by automated computer programs or other illegitimate means;

(h) the incorrect or inaccurate capture of information or the failure to capture or loss of any information; or

(i) communications that are undeliverable as a result of any form of active or passive filtering of any kind, insufficient space in a Participant’s email or voicemail inbox.

Sponsor reserves the right to restrict or void entries or participation from any IP address, Digital Device or other identifiable source if it detects any suspicious entry and/or participation.

 

Important: By participating in the Sweepstakes, each Participant hereby releases and agrees to indemnify and hold the Sweepstakes Entities harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity or the receipt, use or misuse of any prize.

  1. Rights Granted by you: By entering this content you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation and releases the Sweepstakes Entities from any liability with respect thereto.
  2. Force Majeure/Printing and Production Errors: Sponsor reserves the right, without prior notice and at any time, to terminate the Sweepstakes, in whole or in part, or modify, suspend or extend the Sweepstakes or Sweepstakes materials in any way, if it determines, in its sole discretion, that any Sweepstakes materials and/or Prize Claim Documents reflect printing, production or other errors, or if it determines, in its sole discretion, that the Sweepstakes is impaired or corrupted or that fraud or technical problems, failures, malfunctions or errors (including, without limitation, viruses or other deleterious programs or materials, glitches or printing or production errors) have destroyed or severely undermined the proper Entry, integrity and/or feasibility of the Sweepstakes. In the event Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made health epidemic, pandemic, earthquake, explosion, labor dispute or strike, acts of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order or regulation, public health crisis, order of any court or jurisdiction or other cause not reasonably within Sponsor’s control, then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes. Only the type and quantity of prizes described in these Official Rules will be awarded.
  3. Invalidity: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of Sponsor. Miniso’s employees or franchisees are not authorized to modify or amend these Official Rules.

 

  1. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF PEOPLE’S REPUBLIC OF CHINA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively resolved by arbitration administered by the Hong Kong International Arbitration Center (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong and the arbitration proceedings shall be conducted in Chinese. The number of arbitrators shall be 3 (three). Award of the arbitration shall be final and binding. Arbitration fee shall be borne by the losing parties. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
